May 9th, 2024 – Senate Floor Session

WHAT

  • The Minnesota Senate debated, amended, and voted on one gun control bill during a floor session on Thursday, May 9th, 2024.
    • SF 5153/HF 2609:  Binary Trigger Ban / Straw Purchase Penalty Increase
  • As expected, the Senate adopted the House language in HF 2609.  They further amended the language and passed the bill 34-33.  See below for the vote details.

SF 5153/HF 2609 - Trigger Ban / Straw Purchase Penalty

What it does

  • Bans binary triggers from possession or sale in Minnesota using broad language that may also ban other trigger devices
  • Increases the penalties for transferring firearms to prohibited persons
  • Requires a report from the BCA on gun trafficking investigations

Current Bill Status – Senate

  • This will was heard in the MN Senate Judiciary and Public Safety Committee on March 22nd, 2024 and passed on a voice vote.
  • This bill was heard in MN Senate Finance on April 18th, 2024, and passed on a voice vote.
  • This bill was debated, amended, and passed on during a MN Senate floor session on Thursday, May 9th, 2024.  During the Senate floor session, they adopted the House language listed below.

Current Bill Status – House

  • This bill was heard in House Public Safety in early April 2024.
  • This bill received a rules waiver for being past the deadline for committee hearings from the Rules Committee on April 11th, 2024.
  • This bill was to be heard on the House Floor on April 29th, 2024, but was TABLED at the last minute.
  • This bill was debated on the House Floor on May 2nd, 2024, and was passed on a 71-59 vote.
  • The House version was amended and passed by the Senate on May 9th, 2024 on a 34-33 vote.

Where does the MN Gun Owners Caucus stand on this bill?

  • We OPPOSE this bill.

5/9/2024 Senate A7 Amendment to change the Binary Trigger Ban Language

This amendment from the bill author changed the binary trigger ban language to ensure it only applied to binary triggers.  This amendment did gain 1 GOP vote (Abeler) – but all Republicans ultimately voted against the bill when it came up for passage.

TO THE MEMBERS OF THE MINNESOTA LEGISLATURE:

  • Whereas, the anti-gun movement, led by state groups like Protect Minnesota and Michael Bloomberg’s out-of-state-funded Everytown, is attempting to take advantage of recent tragedies to drive home their agenda of gun control
  • Whereas, Governor Tim Walz is calling for a ban on firearms holding more than 10 rounds.
  • Whereas, anti-gun Senators like John Marty and Jen McEwen and Representatives like Leigh Finke are calling for a ban on commonly owned firearms in Minnesota
  • Whereas, House & Senate leadership state that gun control is a top legislative priority
  • Whereas, all gun control measures are unconstitutional and a violation of the Second Amendment to the United States Constitution

THEREFORE, AS A LAW-ABIDING GUN OWNER AND SUPPORTER OF THE SECOND AMENDMENT, I CALL UPON ALL MEMBERS OF THE MINNESOTA LEGISLATURE TO OPPOSE ANY AND ALL GUN CONTROL BILLS.
