📋 Case update: Caucus v. City of Saint Paul (Preemption) Quick recap. St. Paul passed a sweeping gun control ordinance — banning possession of semi-automatic rifles and binary triggers, restricting carry, and more. They wrote it to take effect only if the legislature repeals state preemption, then claimed it harmed no one. We sued anyway. Minnesota law is clear: the legislature has reserved the entire field of firearms regulation to itself, with a few narrow exceptions that don't apply here. Cities don't get to write their own gun laws. The city tried to get our case dismissed, arguing nobody was harmed because the ordinance hadn't taken effect. In other words, they made our argument for us. Judge Castro agreed with us. The law likely applies, and the case moves forward. Now the city has appealed that ruling to the Minnesota Court of Appeals. That appeal is ongoing. We don't have dates yet, and we don't know if the court will take it. If it does, briefing and argument will push a final decision out by some months. That's where things stand. We'll keep you updated at every step, just like we did with the binary trigger case. St. Paul Preemption Lawsuit Update: The City Just Appealed
💬 "When are you going to sue over forced reset triggers?" Fair question. We've been getting it constantly since we won the binary trigger case. Here's the honest answer: probably not anytime soon. And you deserve to know why. The binary trigger ban was buried in a 1,600-page omnibus bill in the last 20 minutes of the 2024 session. That's why we could challenge it under the single-subject clause of the Minnesota Constitution — and win. The FRT ban is different. It was passed in 2023 in a normal, single-subject public safety bill. That legal angle doesn't exist. Overturning it means a Second Amendment challenge in federal court. That road looks like this: Roughly $250,000 to get a decision in federal district court. Another $100,000 to $200,000 when the state appeals to the Eighth Circuit. Another $75,000 to $100,000 in filings if it goes to the U.S. Supreme Court — and low seven figures if the Court takes the case. And we're not confident we'd win. This is an accessory ban with a lot of arguments in play. I'd love to tell you we can walk into federal court, yell "Bruen," and win. It doesn't work like that. Our budget supports about one major case a year. There's lower-hanging fruit we want to litigate first: permits to purchase, permit to carry fees, mandatory training, gun shop zoning. Plus there's an election ahead of us where we need to hold the line and hopefully elect a Pro-2A Governor + Legislative Majority. FRTs are on the list. Just probably not in the near term. Why We're Not Suing Over Forced Reset Triggers (Yet)
⚠️ Quick answer to a question we keep getting: does our binary trigger win make forced reset triggers (FRTs) legal in Minnesota? No. It doesn't. Our binary trigger case was about the single-subject clause of the Minnesota Constitution. The 2024 binary trigger ban was buried in a 1,600-page omnibus bill in the last 20 minutes of the session. That's why we sued, and that's why we won. FRTs are different. We believe FRTs were prohibited by a separate bill passed in 2023 — one that didn't violate the single-subject clause. Our lawsuit had nothing to do with that ban. Bottom line: in our opinion, FRTs remain prohibited in Minnesota under the 2023 law. Did Our Binary Trigger Win Legalize FRTs in Minnesota? No — Here's Why
👉🏼 WE WON. The binary trigger case is over, and binary triggers are legal again in Minnesota. In the final 20 minutes of the 2024 session, the DFL trifecta buried a binary trigger ban inside a 1,600-page omnibus bill. We sued Governor Walz and Attorney General Ellison, arguing the ban and the way the bill was passed violated the single-subject clause of the Minnesota Constitution. We won in Ramsey County District Court last year. The state appealed. The Court of Appeals agreed with us again. And now the state has declined to take it to the Minnesota Supreme Court. Final judgment is in. Binary triggers are legal to purchase, possess, transfer, and sell in Minnesota with no restrictions. Manufacturers are already shipping to the state. WE WON: Binary Triggers Are Legal Again in Minnesota
We won our binary trigger case in Minnesota. So does that make forced reset triggers legal now? Rob Doar, President of the Minnesota Gun Owners Law Center, breaks down why that question is more complicated than it looks. The binary trigger win was real, but it was narrow. The court struck down very specific 2024 language targeting a trigger that fires one round on the pull and another on the release. That language is gone. But there is still broader language in Minnesota statute covering trigger activator devices and anything that lets a semi-automatic fire more than one shot per pull, or resets and keeps firing by harnessing recoil. Could you argue that a forced reset trigger falls outside that broader language? Maybe. You might even be right. But here is the catch Rob lays out: you don't get to make that argument from your couch. You make it after you've been arrested, after you've been charged, after your property has been seized, after expert testimony, after a conviction, and after an appeal. In Minnesota courts. The bottom line: the binary trigger case was a win worth celebrating. Forced reset triggers are a separate, unsettled legal risk, and owning one could make you the test case. The Binary Trigger ban was struck down, so are Forced Reset Triggers (FRTs) legal in Minnesota now?
