
In Duncan v. Bonta, a civil case being appealed from the Ninth Circuit Court of Appeals, the Minnesota Gun Owners Caucus has joined other gun rights organizations in arguing that the US Supreme Court should grant certiorari in this case.
This case challenges California’s ban on common magazines that hold more than ten rounds of ammunition.
Our brief asks the court to grant cert in this case in order to confirm that magazines are arms protected by the Second Amendment, and to instruct the lower courts on the degree of specificity required in historical analysis.
It also emphasizes why the Ninth Circuit is in particular need of correction given its demonstrated hostility to the Second Amendment.
Our brief makes three specific arguments. That magazines are indisputably arms, that lower courts have been improperly using looser analogues when closer analogues existed, and that the Ninth Circuit’s mistreatment of the Second Amendment is enough on its own to warrant certiorari.
