Semi-Automatic and Magazine Bans

In the 2026 session, multiple bills have been introduced to ban most semi-automatic rifles and magazines holding more than ten rounds.  All of these bills have been introduced by DFL legislators; no Republicans have signed on to support these bills.

This page provides the status of these bills, an explanation of what they do, and a guide on how to take action to help STOP this egregious legislation.

What do the Semi-Automatic Ban bills do?

Semi-Automatic Ban – Explaining HF 3433 & SF 3654

  • This bill is a total ban on the sale, transfer, and possession of almost all semi-automatic rifles in Minnesota.
  • There is grandfathering applicable to the current owner only, with no transfers allowed.
  • A certificate must be obtained at an unknown cost, law enforcement must inspect your home for “safe storage” whenever they want without a warrant, and the firearm can only be kept at home or at a “licensed firing range”.
  • Hunting with such firearms is prohibited because you can only have the firearm on your property and a licensed range.

What do the Magazine Ban bills do?

Magazine Ban – Explaining HF 3402 & SF 3714

  • This bill is a total ban on the manufacture, sale, transfer, and possession of all firearm magazines capable of holding more than ten rounds.
  • There is no grandfathering.
  • Magazines must be destroyed, turned into law enforcement, or moved out of state by July 1st, 2026.

Stop the Ban on Semi-Automatic Rifles & Standard Capacity Magazines

Minnesota lawmakers have introduced bills that would ban commonly owned semi-automatic rifles and standard capacity magazines.

If passed, this legislation would force law-abiding citizens to:

  • Surrender their firearms to law enforcement

  • Destroy their private property

  • Move their firearms out of state

  • Or become felons overnight

This is not “public safety.”

It is confiscation.

Semi-automatic rifles are in common use across America for lawful purposes like self-defense and sport shooting. Under District of Columbia v. Heller and New York State Rifle & Pistol Association v. Bruen, the government cannot ban firearms that are commonly owned for lawful purposes. This proposal directly violates that constitutional standard.

Criminals will ignore this law — just as they ignore existing laws.

Only law-abiding citizens will be punished.

The Minnesota Gun Owners Caucus will fight this unconstitutional overreach — but we need you engaged now.

  • DEFEND the Second Amendment

Could these bills pass?

In short, yes.

Right now, the DFL controls the MN Senate by one vote.  They could pass this bill tomorrow, but the GOP could not stop it.  Not a single DFL Senator is pro-gun – they’ve all voted for previous gun control like Red Flag Gun Confiscation, Universal Background Checks, and a Binary Trigger Ban.

The MN House is tied.  The DFL only needs to flip one Republican on a gun vote to pass a gun control bill.

So yes, it could pass.  And that’s why we need to put pressure on our legislators and NOT LET UP.
